  1. In these Conditions, the Company shall mean Milford Haven Port Authority trading as Milford Marina and Docks and/or its Agents or Agents to whom the application for lifting is made which may be one or more of its Associated Companies, Concessionaires, Tenants and Assignees for the operation |if any) of the boatyard, or any other Harbour Facility. The expression "Owner" shall include a Charterer, Master or Agent or other person for the time being lawfully in charge (other than the Company) of the vessel/ vehicle.

  2. The Company will endeavour to lift the vessel as near to the specified period, as in the Company's opinion, tide weather conditions and available facilities permit and in such sequence as to avoid moving other vessels for this purpose and also so as to make the most economical use of the facilities at the Company's disposal. Subject to express agreement to the contrary, any launch date is given in good faith and is not guaranteed, but delivery shall be within a reasonable time of any date specified, bearing in mind all the circumstances of the case.

  3. All persons using any part of the Company's premises or facilities for whatever purpose and whether by invitation or otherwise do so at their own risk, unless any injury or damage to persons or property sustained within the Company's premises or facilities was caused by or resulted from the Company's negligence or deliberate act or that of those for whom the Company is responsible.

  4. All vessels are lifted, moved and stored at the owners' risk. The Company will not be liable for any structural damage to any vessel, including hull fittings, propulsion units, transducers etc, if it is deemed by the Company that the damage is the result of inadequate information on the part of the owner or his appointed representative.

  5. In the case of a vessel being stored in its own cradle, the owner is to ensure that the cradle is suitable for that purpose and that all moving parts are serviceable. However, the Company reserves the right to refuse use of the owners cradle if they deem the cradle is unsuitable or unserviceable.

  6. Owners are to ensure that once the vessel is in place in the boatyard, that all sails, fenders, tenders ( of whatever construction) spray hoods and dodgers are removed and stored securely. The Company will not be held responsible for any damage caused to any vessel in the boatyard which has suffered damage to the non stowing of auxiliary items.

  7. Owners are recommended in accordance with the British Marine Federation guidelines, to remove masts for winter storage. The Company will not be held responsible for any damage caused due to the non-removal of masts whether it be to their own vessel or other property within the confines of the boatyard. However the owner will be held responsible for any damage caused by their offending mast.

  8. It is the Company's responsibility to ensure that the lifting equipment is maintained and serviced in the guidelines laid out by the manufacturer and that hoist operators are to be adequately trained.

  9. If the owner requires additional protection to the hull from the hoist slings, this is to be added prior to the commencement of the lift. The protection is to be provided, fitted and disposed of by the owner. The Company will not be held responsible for any damage caused to the owners' vessel which has resulted in extra protection being fitted.

  10. It is strictly prohibited to reside on a vessel within the boatyard.
